End User License Agreement

1. What this agreement covers

This End User License Agreement ("EULA") is between you and NxtLvL. It covers the NxtLvL software: the website, its pages and code, any NxtLvL app or installable web app, and their updates (together, "the Software"). By creating an account or using the Software, you agree to this EULA. If you're under 18, your parent or guardian agrees to it for you. If you don't agree, don't use the Software.

2. Your license

NxtLvL gives you a personal, limited, non-exclusive, non-transferable, revocable license to use the Software to:

• create and manage your account and profile,
• post, view, and interact with content, and message other members as the Software allows,
• and, if you're a coach, scout, counselor, or team, use it for your work of finding, following, and supporting athletes.

The Software is licensed, not sold. NxtLvL keeps every right not clearly given to you here.

3. What you can't do

You may not, and may not help anyone else to:

• Copy, change, translate, or make works based on the Software, except as the law expressly allows.
• Reverse engineer, decompile, or try to find the source code or the way the Software or its database is built, except as the law expressly allows.
• Scrape, crawl, or collect data from the Software (athlete stats, profiles, posts, usernames, or contact details) by bots, scripts, or any automated means, or build a database, list, or service from it.
• Sell, rent, lend, share, or sublicense your access, your account, or data from the Software.
• Get around or test security, verification, age checks, rate limits, or content filters, or use another member's account.
• Upload viruses or harmful code, overload the Software, or interfere with how it works for others.
• Remove or change NxtLvL's names, logos, or notices, or make it look like NxtLvL endorses you.
• Use the Software to break any law or the Terms of Service.

4. Who owns what

NxtLvL owns the Software, including its design, code, look and feel, the NxtLvL name and logo, and how its information is organized and compiled. Your content stays yours, as described in the Terms of Service. If you send us ideas or feedback, we may use them freely without paying you or giving you credit.

5. Updates and changes

We may update, change, add, or remove features of the Software at any time, sometimes automatically and without notice. This EULA covers every update. We don't have to keep any feature, and we may stop offering the Software.

6. Other companies' software and services

The Software uses services and code from other companies, including Google Firebase (hosting, sign-in, and storage) and video tools. Those parts may come with their own terms, and NxtLvL is not responsible for them. Using the Software also needs a working internet connection and a supported browser, which you provide.

7. Ending this license

This license lasts until it ends. It ends automatically if you break this EULA or the Terms of Service, and NxtLvL may end it at any time by suspending or deleting your account. You can end it by deleting your account and no longer using the Software. When it ends, you must stop using the Software. Sections 3, 4, 8, 9, and 10 still apply after it ends.

8. No warranty

The Software is provided "as is" and "as available", with all faults and without any warranty, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. NxtLvL doesn't promise that the Software will meet your needs, work without interruption or errors, or keep your content safe from loss. Keep your own copies of anything important.

9. Limits of liability

To the fullest extent the law allows, NxtLvL and the people who run it are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, opportunities, or profits, arising from the Software or this EULA, even if told such damages were possible. NxtLvL's total liability under this EULA is limited to $100. Some places don't allow these limits, so they may not all apply to you.

10. Governing law

This EULA is governed by the laws of the State of Wisconsin and applicable U.S. federal law, and disputes are handled as described in the Terms of Service. If any part of this EULA can't be enforced, the rest still applies. We may update this EULA; the Terms of Service explain how.
